Verzicht auf die Angabe einer Postanschrift
Gemäß § 5 TMG besteht eine Pflicht zur Angabe einer ladungsfähigen Anschrift. Gleichzeitig unterliegt der Betreiber dem Schutz des Grundrechts auf informationelle Selbstbestimmung (Art. 2 Abs. 1 i.V.m. Art. 1 Abs. 1 GG). Nach sorgfältiger Abwägung dieser beiden Rechtspositionen wird auf die Veröffentlichung der privaten Anschrift verzichtet. Die Veröffentlichung würde ein unverhältnismäßiges Risiko für die private Sicherheit des Betreibers darstellen und steht im Widerspruch zum Prinzip der Datenminimierung gemäß Art. 5 DSGVO.

Waiver of Postal Address Publication
According to § 5 TMG, there is an obligation to provide a summonable address. At the same time, the operator is protected by the fundamental right to informational self-determination (Art. 2(1) in conjunction with Art. 1(1) of the German Basic Law). After careful consideration of these two legal positions, the publication of the private address is waived. Its publication would pose a disproportionate risk to the operator's personal security and contradicts the principle of data minimization under Art. 5 GDPR.
